His handwritten notes used during the Missouri salvage case of 1854
Autograph Manuscript signed: "Rufus Choate", 2 pages (front and verso), 7½x9½. No place, no date, but circa 1854. Ink note (unknown hand) in left margin: "Notes of Hon. Rufus Choate/in the Missouri salvage case." Densely written notation in Choate's hand, evidently prepared for use in a civil dispute about salvage of specie from the barque Missouri, which had run aground on the coast of Sumatra in 1852. The master of the Missouri, and also of a rescue vessel, had already been found guilty of fraud in a criminal case, proven to have conspired to hide the rescued cargo and divide it between them. Choate was pleading for the company owning the Missouri, regarding disposition of the cargo - subsequently recovered - in opposition to the claims of crew members, including the conspirators. The court was regaled when the Missouri's master, under questioning by Choate, reluctantly revealed that he had expected to get away with his crime by hiring the skilled lawyer, Rufus Choate, to defend him: "He would get us off if we were caught with the money in our boots." (as told by Samuel Gilman Brown, editor of Choate's papers). Rufus Choate (1799-1859) was elected to succeed Daniel Webster who resigned his Senate seat to become Secretary of State, completing his term, 1841-1845. (He had formerly served in the US House of Representatives (1831-1834). Choate was and eloquent orator and one of the most skillful lawyers of his time, called "the wizard of the law". (He successfully defended a client accused of murder by the first ever use of the sleepwalking defense.) Unlike most of his fellow Whigs, Choate did not Republican, supporting Democrat James Buchanan for President in 1856 because he considered the Republican Party a sectional one. Irregularly cut and frayed at left edge. Lightly creased. Lightly worn. Otherwise, fine condition.
